First court day in new facility

Tuesday, September 22, was the first day of fall. It was also the first day of legal proceedings in the courts building that is part of the Forney Justice Center which became operational during the first week of this month.

Plea hearings began at 9:00 a. m. Tuesday, with Forney Municipal Court Judge Patricia Ashcroft presiding.

During the morning session, Judge Ashcroft took pleas from approximately 12 young people ranging from late-age juveniles to adults between 18 and 21.  Nearly all of those entering pleas appeared with a parent. Most of the cases involved simple assault, public intoxication and traffic offenses.

At the outset, Judge Ashcroft explained their rights to the accused. They could plead guilty, no contest or not guilty. A not guilty plea indicates that the accused wants the charges proven in a trial, which can either be before the judge only or in front of a jury. A no contest plea waives the right to a trial, but the accused has the same options as under a guilty plea.

All of the cases were styled and accordingly announced as “State of Texas vs. —”.

Most of those appearing for plea hearings Tuesday pled guilty or no contest. However, several pled not guilty, and their cases will  go to trial at a later time.

Most of those pleading guilty or no contest were assessed a penalty immediately. Most had to pay a fine. Some of those with traffic offenses were allowed to take defensive driving. Minors found in possession of alcohol had to meet special requirements imposed by the court but were told that if the requirements are met and the defendant has no other alcohol-related offenses before reaching 21, the charge will be expunged from the record.

The plea hearing session lasted approximately an hour, with the court docket being cleared at approximately 10:00 a. m.
